Japan Moves to Reclassify Cryptocurrencies as Financial Assets

Japan is taking a significant step in the regulation of digital assets by moving to classify cryptocurrencies as financial assets rather than treating them solely under the Payment Services Act. The change comes after Japan’s parliament approved amendments that will bring cryptocurrency assets under a stricter regulatory framework.

Under the revised approach, major cryptocurrencies, including Bitcoin and Ethereum, will be regulated under the Financial Instruments and Exchange Act (FIEA). The new framework is expected to strengthen oversight of the crypto market and align Japan’s regulatory standards more closely with those applied to traditional financial assets.

One of the key implications of the reclassification is the introduction of stricter rules governing market conduct. Cryptocurrency assets will become subject to regulations such as insider trading restrictions, while penalties for unregistered trading activities will also be increased. The legislation additionally introduces greater compliance requirements, including annual disclosures for issuers and stronger enforcement measures for non-compliance.

The move comes as cryptocurrency adoption in Japan continues to grow.
